X.     TERMS AND CONDITIONS:

The use and access of this site applies without exception to all users and are subject to the following terms and conditions and other applicable laws. If you do not agree to these terms and conditions, please do not use this website (www.themiamicleaners.com).

 

XI.     RIGHT OF REFUSAL: The Miami Cleaner’s reserves the right to refuse service to anyone for any reason. These reasons include but are not limited to: not being able to gain entry to a home, no power, no electricity, no air conditioning or heating, frequent cancellations or schedule changes, improper or dishonest booking(s), project out of scope of the original booking, not listing all the bedrooms or bathrooms (even if we’re not cleaning them), being rude to team members, poaching or attempting to poach team members away from The Miami Cleaner’s (at any price), and/or incorrect or non-functioning billing information.

 

XII.     CANCELLATION POLICY: Any appointment canceled or postponed less than 24 hours before the scheduled cleaning time will be subject to a Late Cancellation fee of $40.  All future services will remain unchanged. Schedule or service changes may not be made through service providers. Please contact our office directly for schedule changes. Termination of regularly scheduled services must be in writing.

 

XIII.     PAYMENT: We accept Amex, MasterCard and Visa. No cash or checks will be accepted. A hold on funds will placed 24 hours before your scheduled service, your credit card will not be charged until service has been completed. Full payment is due on the day of your service. A credit card number must be kept on file with our office. Your account will be charged the balance due, plus any fees, on the day of your service.

 

XIV.     GIFT CARDS: Gift cards are redeemable by the bearer for services within the service areas provided by The Miami Cleaner’s. Gift Cards may not be returned, refunded or redeemed for cash. Please treat gift cards like cash; it is not replaceable if lost or if used without authorization. Gift Cards are delivered via email instantly and can be applied to any of our services.

 

XV.     PROPERTY DAMAGE AND ACCIDENT POLICY: We treat your home with great care, but some accidents due occur; therefore we ask that if you have any irreplaceable, collectable, antiques, or expensive objects, we ask that those items be properly secured or put away in order to avoid accidents, or loss of those items.

The Miami Cleaner’s is not responsible for damage due to faulty installation, light fixtures, ceiling fans, pictures, or improperly secured items. Please inform us of any items in your home that require this type of attention.

​

Team members are required to notify the client of any accidental damage that occurs during each job. In the event the client notices any other loss/damage we are not aware of in the house, as a result of your cleaning service, the client must notify The Miami Cleaner’s of any incident within (24) hours after service to be considered for reimbursement. The Miami Cleaner’s reserves the right to deny and provide reimbursement if the above conditions are not met satisfactorily.

 

XVI.     REFUNDS: Since cleaning is a very personalized and subjective service, we cannot offer refunds to customers. However, The Miami Cleaner’s backs all of its work with a 100% Satisfaction Guarantee. If you are not completely satisfied with the work we have performed, please call our office within (24) hours of the cleaning. We will be happy to re-clean the area is in question, for free, until you are completely satisfied.

 

XVII.     24-HOUR CLEANING GUARANTEE: The Miami Cleaner’s will happily re-clean any area that you are not satisfied with. Just let us know of any issues or concerns within 24 hours of your service and we will do our best to make it right. Our guarantee is part of our commitment to our customers. We want our customers to be satisfied with the work we perform, and we welcome feedback and comments to help us increase customer satisfaction.

 

XVIII.     CLEANING SCHEDULING: Recurring services are scheduled according to our priorities discussed when defining your service. One-Time Services are scheduled as standard blocks of time. Every effort will be made to complete your service within the time allocated. Please note that it will take a few services to confirm your ongoing maintenance needs. We ask for your patience while we learn how to best clean your home and assure you that we will move from deep service into maintenance service as quickly as possible.

We strive to have the same staff members clean your home on a regular basis, however, this is not guaranteed. Due to vacation, illness or departure from the company, The Miami Cleaner’s may occasionally provide a replacement service team member.

If, due to the unique nature of your home, your service team member is unable to complete your service within the amount of time requested, we may call you to ask for authorization to spend more time to service your home. We will inform you of additional costs accordingly before a team member proceeds with the work.

 

XIX.     ARRIVAL: To ensure quality service for all valued clients, The Miami Cleaner’s cannot specify exact arrival times. Arrival windows allow our service TEAM MEMBERS to handle all the variables of each day and each home without affecting the promises we make to you.

If you reside in a condominium or apartment building, please note that the clock will begin from the point we arrive at the front desk.

 

XX.     IN-HOME TIME (LABOR HOURS): Generally, our service team members work in teams of one or two. Please note that, when more than one person is assigned, the quoted time required to complete the job, which was given in labor hours, is reduced. For example, if you were scheduled for a six labor-hour service and two service team members are assigned, the total in-home service time is three hours.

 

XXI.     HOLIDAYS: If your scheduled service falls on a holiday that The Miami Cleaner’s observes, we will contact you to reschedule your service.

 

XXII.     FEEDBACK: Since service is a very personalized and subjective service, we need your feedback to help us provide our services. Please take a moment to email us at support@themiamicleaners.com. We value your opinion and your feedback is essential for us to serve you better.

 

XXIII.     GRATUITY: The Miami Cleaner’s never requires you to tip, but it is a generous way to say thank you to your service team member. Even a personal note from you expressing your appreciation for their service can mean a great deal.

 

XXIV.     SUPPLIES: The Miami Cleaner’s uses high-quality, tested, and service supplies, including a professional-strength vacuum cleaner with an extra-strong filter, to clean your home. However, if you own special products that you would like to have used on particular surfaces, we are happy to accommodate your request. Please contact our office to discuss prior to your service so we may provide instructions to our team member.

 

XXV.     SITE SECURITY: Your security is a priority at The Miami Cleaner’s. To provide credit card security and keep your personal information safe, we use Secure Sockets Layer (SSL) technology, the most widely used data encryption coding system for secure e-commerce transactions. All of your information is encrypted (scrambled) prior to being sent over the Internet to our system. To protect your information once we receive it, we place it on systems behind secure firewalls, which are communication-management computers designed to keep information safe and inaccessible to other Internet users. If your browser doesn't accept the SSL technology, transactions will not be permitted.

To confirm that your connection is secure, look for the letters “https” (rather than “http”) located in the URL address window at the top of your browser to indicate that you are using a secure browser.

 

Opt-In: Submitting a booking request and/or calling The Miami Cleaner’s to request an estimate are treated as an opt-in to receive service related follow up and information from The Miami Cleaner’s.

• If you supply us with your postal address you may receive periodic mailings from us with information on promotions, services or upcoming events.

• If you supply us with your telephone number, you may receive telephone contact from us with information regarding requested services.

• If you supply us with your mobile telephone number, you will receive texts from us once you have become a The Miami Cleaner’s customer

• Opt-Out: How do you opt-out of receiving future communications?

• If you do not want to receive e-mail from us in the future, please let us know by contacting our The Miami Cleaner’s office or by sending us an e-mail at support@themiamicleaners.com. You may also unsubscribe to future emails by clicking on the unsubscribe link contained within e-mails you receive.

• If you do not wish to receive postal mailings or phone calls, please let us know by contacting our The Miami Cleaner’s office or by sending us an e-mail at support@themiamicleaners.com

• If you do not wish to receive texts from us, you can simply reply to the text you received with the word Stop at any time. If you wish to resume receiving texts after opting out simply reply with the word Start to any text that you received from us.

XXVI.     TERMS AND TERMINATION: These terms and conditions are applicable to you upon your accessing the site and/or completing the information request. These terms and conditions, or any part of them, may be terminated by The Miami Cleaner’s without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Governing Law, shall survive any termination.

XXX.     TYPOGRAPHICAL ERRORS: The Miami Cleaner’s has made every effort to ensure service information prior to a scheduled appointment. In the event that a The Miami Cleaner’s service is mistakenly listed at an incorrect price, The Miami Cleaner’s reserves the right to refuse or cancel any orders placed for services and/or products listed at the incorrect price. The Miami Cleaner’s reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged.

If your credit card has already been charged for the purchase and your order is canceled, The Miami Cleaner’s shall issue a credit to your credit card account in the amount of the incorrect price.

 

XXXI.     GOVERNING LAW: Your use of this site shall be governed in all respects by the laws of the state of Florida, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of The Miami Cleaner’s products or services) shall be in the state or federal courts located in Miami Dade County, Florida. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of The Miami Cleaner’s products or services) must be commenced within one (1) year after the claim or cause of action arises.

The Miami Cleaner’s failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. The Miami Cleaner’s may assign its rights and duties under this Agreement to any party at any time without notice to you.

 

XXXII.     NOTICE: The Miami Cleaner’s may deliver a notice to you by means of e-mail and/or text message, a general notice on the site, or by other reliable method to the address you have provided to The Miami Cleaner’s and/or affiliates.

 

XXXIII.     USE OF THIS SITE: Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including The Miami Cleaner’s or other team member, employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. XXXVI.     THIRD PARTY LINKS: In an attempt to provide increased value to our visitors, The Miami Cleaner’s may link to sites operated by third parties. However, even if the third party is affiliated with The Miami Cleaner’s, The Miami Cleaner’s has no control over these linked sites, all of which have separate privacy and data collection practices, independent of The Miami Cleaner’s. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, The Miami Cleaner’s seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work).

XXXV.     OTHER TERMS AND CONDITIONS: All other terms and conditions of the Agreement shall remain in full force and effect. Nothing contained herein shall be construed as amending or modifying the Terms of Service.
